Terms of Service

1. Acceptance of Terms

By accessing and using ViralSky, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Service Provider: These Terms of Service are provided by Infinee s. r. o., a Slovak limited liability company registered in Slovakia.

2. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

• Maintaining the security of your account and password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3. Subscription and Payment

ViralSky offers subscription plans with recurring payments processed through Stripe. We currently offer three subscription tiers:

• Pro Plan: $5 per month or $50 per year (450 credits monthly)
• Ultra Plan: $10 per month or $90 per year (1,300 credits monthly)
• Max Plan: $20 per month or $180 per year (4,000 credits monthly)

By subscribing, you agree to:

• Pay all fees associated with your subscription
• Automatic renewal of your subscription at the end of each billing period unless cancelled
• Payment processing through Stripe, which handles all payment information securely
• Subscriptions are billed in advance on a monthly or annual basis

Refund Policy: We offer a 14-day money-back guarantee for new subscriptions. If you are not satisfied with our service within the first 14 days of your paid subscription, contact us at info@viralsky.ai for a full refund. Refunds are processed within 5-10 business days. After the 14-day period, no refunds will be provided for partial billing periods.

Cancellation: You may cancel your subscription at any time through your account settings or by accessing the Stripe Customer Portal. Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until the end of the paid period. No refunds are provided for the remaining period after cancellation.

Price Changes: We reserve the right to modify subscription prices. We will notify you at least 30 days in advance of any price changes. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.

3a. Lifetime Deal (LTD) — Special Terms

The ViralSky Ultra Lifetime Deal is a limited-time offer (when available) providing lifetime access to the Ultra tier in exchange for a single up-front payment of $149. These terms continue to apply to accounts that purchased the Lifetime Deal. By purchasing the Lifetime Deal you acknowledge and agree to the following terms in addition to the general subscription terms above:

• One-time payment: $149 USD, charged once at purchase. There are no recurring charges.
• Credits: 1,300 credits are refilled on the 1st of every calendar month for as long as the Service is operated. Unused credits do not roll over.
• Refund policy: Lifetime Deal purchases are final and non-refundable.
• Non-transferable: A Lifetime Deal licence is tied to the original purchasing account and email address. It may not be resold, gifted, or transferred to another account.
• Single purchase per account: Only one Lifetime Deal may be held per account. Additional LTD purchases from the same account may be refunded at our discretion.
• Upgrade from existing subscription: If you hold an active monthly or annual ViralSky subscription at the time of LTD purchase, that subscription will be automatically cancelled without prorated refund. The remaining prepaid period is forfeited in exchange for lifetime access.
• Scope: Lifetime access covers Ultra-tier features as they exist at time of purchase plus any future improvements delivered to the Ultra tier. Entirely new, separately-priced products or tiers are not automatically included.
• Service continuity: "Lifetime" means the operational lifetime of ViralSky. We will provide at least 90 days' written notice and a pro-rata refund of the purchase price (scaled by time since purchase) in the unlikely event the Service is permanently discontinued within the first 24 months. After 24 months the LTD is considered fully earned and no refund applies.
• Account termination for abuse: Lifetime access may be revoked without refund if you breach these Terms, including the prohibited-uses section below.

The Lifetime Deal is offered in limited quantity and/or for a limited promotional window. We reserve the right to end or modify the offer at any time; previously completed purchases remain bound by the terms in effect at the time of purchase.

4. Service Description

ViralSky is an AI-powered viral content generation platform that provides:

• AI-powered generation of viral social media threads and content
• Access to proven templates and content structures
• Viral image library and comment templates that can be copied and used
• Multi-platform support for Twitter/X, Facebook, LinkedIn, and Threads
• Integration with top AI providers (OpenAI, Anthropic, Google AI, XAI)

The service operates on a credit-based system where each content generation consumes credits based on your subscription tier.

5. Content and Intellectual Property

You retain ownership of content you generate using our service. However, you grant us a license to:

• Use, store, and process your content to provide the service
• Improve our AI models and services (anonymized where possible)

All content generated by AI may be subject to the terms of the AI provider's service. You are responsible for ensuring that any content you generate and publish complies with applicable laws and platform terms of service.

6. Prohibited Uses

You may not use our service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code

7. Service Availability

We reserve the right to withdraw or amend our service, and any service or material we provide, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the service is unavailable at any time or for any period.

8. Disclaimer

The materials on ViralSky are provided on an 'as is' basis. ViralSky makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9. Limitation of Liability

In no event shall ViralSky or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on ViralSky, even if ViralSky or a ViralSky authorized representative has been notified orally or in writing of the possibility of such damage.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Slovak Republic. Any disputes arising from these terms or the use of our service shall be subject to the exclusive jurisdiction of the courts of Bratislava, Slovakia.

For users in the European Union, you also have the right to lodge a complaint with your local data protection authority if you believe we have violated your data protection rights.
